In accordance with the Individual Privacy Act (2075), we collect:

  • User Preferences: Information provided to customize guides (e.g., travel dates, interests).
  • Communication Logs: Interactions with our chat or email support.
  • Property Media: For Hosts, any media uploaded is used by nameAstay for curation and social media marketing. You grant us a non-exclusive license to edit and repurpose this content for promotional “guides.”

1.3 Data Security

We utilize industry-standard encryption to protect your data. We do not sell user data to third parties. Any external links in our guides are subject to the privacy policies of those specific third-party providers.


2. Terms of Use

2.1 Nature of Curated Content

Our guides are for informational and inspirational purposes only.

  • Editorial Independence: Our “curated” status means we select properties based on specific criteria. This does not constitute a legal guarantee of the property’s service quality.
  • Accuracy of Information: While we strive for accuracy, travel details (prices, opening hours, trail conditions) in Nepal change rapidly. Users are responsible for verifying information directly with service providers before travel.

2.2 Limitation of Liability

  • No Booking Services: nameAstay is not a travel agency or a booking engine. We do not facilitate payments. Your contract for any stay or tour is solely with the end-provider.
  • Assumption of Risk: Travel in Nepal involves inherent risks (weather, terrain, altitude). nameAstay and Mellon Company Pvt. Ltd. shall not be held liable for any injury, loss, or dissatisfaction resulting from following our curated suggestions.

2.3 Compliance with Nepal Tourism Regulations

  • Mandatory Guides: Per Nepal Tourism Board (NTB) 2026 Regulations, foreign trekkers in regulated zones must hire a licensed guide. Our guides provide information on these rules.
  • Host Verification: Hosts listed in our “Curated” section must hold valid registration with the Department of Tourism or local Ward offices.

2.4 Dispute Resolution

Any disputes arising from the use of our digital content shall be governed by the Electronic Transactions Act (2063) and settled via arbitration in Kathmandu, Nepal.
