- Host & Media Content: Property details, pricing, location data, and promotional photographs uploaded by hosts or submitted for listing. By submitting media, Hosts grant Mellon Company Pvt. Ltd. a non-exclusive, royalty-free, worldwide license to display, reformat, and distribute such media solely for directory listings, curated guides, and social media marketing.
1.3 Data Security, Usage & User Rights
- Usage: Data is used strictly to provide directory services, process inquiries, and improve user experience. We do not sell, rent, or trade your personal data to third-party marketers.
- Security: We employ industry-standard security measures against unauthorized access, alteration, or disclosure of data under our control.
- User Rights & Data Withdrawal: Under the Individual Privacy Act (2075), you have the right to request access to, correction of, or permanent deletion of your personal data or listed property profiles by contacting us at nameastay@gmail.com.

2. Terms of Use
2.1 Directory & Curated Content Disclaimer
- Informational Purpose Only: Content, itineraries, trail notes, price ranges, and listings on nameAstay are provided purely for informational and directory discovery purposes.
- Dynamic Information: Travel conditions in Nepal (including teahouse rates, road access, trail safety, and operating hours) change rapidly. Users are strictly responsible for directly confirming current rates, availability, and safety conditions with end-providers before embarking on travel.
- No Guarantee: Inclusion in our “Curated” or featured categories reflects specific listing criteria at the time of publication and does not constitute a formal legal guarantee, endorsement, or warranty of service quality, hygiene, or safety.
2.2 Limitation of Liability & Intermediary Status
- No Booking or Agency Services: nameAstay is an online directory and informational platform, not a registered travel agency, tour operator, or booking engine. We do not process booking transactions, collect stay payments, or act as an agent for any host or guide. Any agreement, payment, or reservation made is strictly a bilateral contract between the traveler and the third-party service provider.
- Assumption of Risk: Travel, trekking, and outdoor activities in high-altitude or remote regions of Nepal involve inherent environmental, logistical, and physical risks (including altitude sickness, landslides, unpredictable weather, and road conditions). Mellon Company Pvt. Ltd., its directors, and operators shall not be held liable for any personal injury, loss, property damage, delayed itineraries, or dissatisfaction resulting from reliance on directory information or services provided by third-party hosts.
2.3 Compliance with Nepal Tourism & Trekking Regulations
- Mandatory Guide & Permit Compliance: Foreign trekkers traveling in designated national parks, conservation areas, or restricted zones in Nepal are subject to prevailing Nepal Tourism Board (NTB) regulations regarding mandatory licensed trekking guides and permits (such as TIMS, ACAP, MCAP, and restricted area permits). Travelers are solely responsible for ensuring complete legal compliance before trekking.
- Host & Operator Licensing: While nameAstay encourages hosts and guides to maintain valid local Ward registrations and Department of Tourism licenses, nameAstay does not conduct continuous legal audits of listed providers. Travelers should independently verify credentials for critical activities.
2.4 Governing Law & Dispute Resolution
These Terms and any disputes arising from your use of nameAstay shall be governed by and construed in accordance with the laws of Nepal, including the Electronic Transactions Act, 2063 (2006). Any legal disputes or claims that cannot be resolved amicably shall be submitted to binding arbitration in Kathmandu, Nepal.
